Appellate Court hits Aquarion with delinquency order in PURA case

The state Appellate Court on Tuesday issued a delinquency order in Aquarion Water Co.’s appeal of a trial court’s decision to uphold a rate cut imposed by the Public Utilities Regulatory Authority.

The order says the appellant, Aquarion, has not pursued proper diligence. Aquarion ordered trial court transcripts on April 8, but did not provide an estimated delivery date to the Appellate Court.

According to the delinquency order, the case will be dismissed unless Aquarion provides the court notice of when the trial court transcripts will be delivered or completed.

In March, Aquarion filed an appeal with the Appellate Court seeking to overturn a judge’s decision in favor of the Public Utilities Regulatory Authority.

New Britain Superior Court Judge Matthew Budzik upheld PURA’s March 2023 decision to cut $40 million from Aquarion’s proposed revenue increase.

In the initial appeal, Aquarion argued that PURA’s decision was “confiscatory” and threatened its financial stability.

Aquarion issued the following statement regarding the delinquency order:

“The notice was a clerical notice about filing an estimated date of delivery for the court reporter’s transcript. It does not involve the substance of the appeal and the Company’s pursuit of a remedy of claims will continue.”
